Website Hosting Terms and Conditions
Effective date: 17 January 2026
These Terms and Conditions govern the website hosting services provided by Your Uniqueness, operated by Naadia Jackson-Amiga. By purchasing or using our hosting services, you agree to the terms outlined below.
1. Introduction
These Terms and Conditions set out the agreement between Your Uniqueness and the client using our website hosting services.
Our hosting service is designed for small business owners who want a secure, reliable place to host their website without needing to manage the technical side themselves.
By using this service, you confirm that you have read and agree to these terms.
2. Definitions
For the purposes of this agreement:
“Provider” refers to Your Uniqueness, operated by Naadia Jackson-Amiga.
“Client” refers to the person or business purchasing hosting services.
“Hosting Service” refers to the website hosting provided through our SiteGround reseller environment.
“Website” refers to the website files, database, and content belonging to the client.
3. Services Provided
Your Uniqueness provides website hosting using a managed reseller hosting environment through SiteGround.
The hosting service includes:
Secure website hosting
SSL certificate
30-day rolling website backups
Basic server management
Standard hosting security
This service provides hosting only.
The following services are not included in standard hosting:
Website updates
Plugin or theme updates
Content edits
Website troubleshooting
Website redesign or development
Ongoing maintenance
These services are available through separate Website Management Packages.
4. Payment Terms
Hosting plans are available on either:
Monthly billing, or
Annual billing.
Invoices must be paid by the due date stated on the invoice.
Payments may be made using the payment methods specified at the time of purchase.
Hosting services will continue as long as payments remain current.
5. Late Payments and Suspension
If payment is not received by the due date:
A reminder may be issued.
A late fee may be applied.
Hosting services may be suspended.
Suspended websites may become temporarily unavailable until the account is brought up to date.
Your Uniqueness reserves the right to permanently remove hosting services if payment remains overdue for an extended period.
Reinstatement of suspended services may incur an administration fee.
6. Cancellation and Website Transfers
Clients may cancel their hosting service at any time.
If the client wishes to move their website to another hosting provider, Your Uniqueness can provide a full website backup for transfer.
A $200 website transfer fee applies. This includes:
Creating a complete backup of the website
Preparing the files for transfer
Supplying the backup to the client
Clients are responsible for arranging their own new hosting provider and restoring the website.
Once the transfer has been completed and the hosting account cancelled, access to the hosting environment will be removed.
7. Acceptable Use Policy
Clients must not use the hosting service for activities that are illegal, harmful, or abusive.
The following are strictly prohibited:
Hosting illegal or unlawful content
Distributing malware or malicious software
Sending spam or bulk unsolicited email
Hosting adult or explicit content
Activities that create excessive server load
Content that infringes on copyright or intellectual property rights
Any activity that threatens the security or stability of the hosting environment
Your Uniqueness reserves the right to suspend or terminate services if these conditions are breached.
8. Client Responsibilities
Clients are responsible for the content and operation of their website.
This includes:
Ensuring they have the legal right to use all text, images, and media
Keeping login credentials secure
Maintaining current contact and billing information
Managing their domain name if it is registered elsewhere
Clients are also responsible for maintaining their website software unless they have a separate management agreement in place.
9. Service Availability and Limitations
Your Uniqueness works to provide reliable hosting services. However, uninterrupted service cannot be guaranteed.
Service interruptions may occur due to:
Server maintenance
Platform updates
Internet infrastructure issues
Third-party software conflicts
Security incidents or technical failures
Because hosting relies on third-party systems and infrastructure, Your Uniqueness cannot guarantee 100 percent uptime.
10. Backups and Data Protection
The hosting service includes automated rolling backups for approximately 30 days.
Backups are provided as a safeguard but are not guaranteed as a recovery solution.
Clients are encouraged to maintain their own copies of website files where possible.
Your Uniqueness is not responsible for data loss resulting from website errors, hacking, plugin failures, or third-party software.
11. Limitation of Liability
To the fullest extent permitted by law, Your Uniqueness is not liable for:
Loss of website data
Business interruption
Loss of revenue
Website downtime
Third-party platform failures
Where liability cannot be excluded, it is limited to the amount paid by the client for the hosting service within the previous 12 months.
12. Intellectual Property
All content hosted on the client’s website remains the property of the client or the rightful copyright owner.
Clients confirm that they have the rights to all materials used on their website.
Your Uniqueness does not claim ownership of client website content.
13. Portfolio Use
Unless otherwise requested by the client, Your Uniqueness may display the client’s website in:
Portfolio examples
Marketing materials
Case studies
This helps demonstrate the types of websites we support.
Clients may request removal from the portfolio at any time.
14. Termination
Your Uniqueness reserves the right to terminate hosting services if:
These terms are violated
The service is used for unlawful purposes
Payments remain overdue
The hosting environment or other users are placed at risk
Termination may occur with or without notice depending on the severity of the breach.
15. Dispute Resolution
If a dispute arises, both parties agree to attempt resolution through good-faith mediation before pursuing legal action.
If the matter cannot be resolved through mediation, it will be handled through the courts of New Zealand.
16. Governing Law
These Terms and Conditions are governed by the laws of New Zealand.
Any legal proceedings must be brought within New Zealand jurisdiction.
